RPWB Opposes Proposed $2 Billion Roundup Cancer Settlement

AIKEN, S.C. – Rogers, Patrick, Westbrook & Brickman joined more than 90 other law firms in opposing a proposed class action settlement for people who have developed cancer as a result of exposure to Roundup Weed Killer.

The proposed $2 billion settlement is deeply flawed and would impair cancer victims’ ability to seek appropriate recourse from Monsanto. The chemical giant continues to manufacture Roundup to this day despite science showing how dangerous the product is.

The proposed settlement does not benefit people harmed by Roundup and instead is a way for Monsanto to cap its risk and to reduce how much it will pay to people injured by their products. We also fear this settlement may become a blueprint for other corporations accused of wrongdoing in the future to shirk taking full responsibility for the harm they have caused.

These are three main facets of the proposed deal that are the most problematic:

  • The proposed settlement gives up all of the class members’ punitive damages claims, which would curtail the amount of compensation they receive.
  • People harmed by Roundup would see their litigation against the company stayed (delayed) for four years. During that time, they would be barred from pursuing a lawsuit against Monsanto.
  • The settlement creates a secret science panel that does not include prominent researchers of the cancer-causing ingredient in Roundup. This panel would operate in total darkness to create a single, carefully controlled deposition that would serve as the stipulated ‘science’ of whether Roundup causes cancer in all future litigation.

The proposed settlement is pending in the United States District Court of the Northern District of California.

$5.4 Million Settlement Reached in Fatal Charleston DUI

CHARLESTON, S.C. — A case involving a 32-year-old Chicago man who was killed by a drunk driver in Charleston recently resolved for $5.4 million.

In January 2019, William Kappel, Jr. (deceased), his wife Laura, and Jacqueline Zink traveled to Charleston to visit their friend Joseph Murray, who had recently moved to the Lowcountry from Chicago. As they were heading home from an evening out in downtown Charleston, their vehicle was struck by a drunk driver.

Crash data revealed that the drunk driver, Cade Garris, reached speeds of 74 mph in a 35 mph zone moments before he ran a red light on Meeting Street and caused the fatal collision. Plaintiffs’ investigation revealed that Garris had been drinking at two establishments in downtown Charleston before he got behind the wheel to drive home. Later toxicology results also indicated that Garris was over twice the legal limit at the time of the collision.

Garris was underinsured and the bar defendants funded the bulk of the settlement. As a part of the settlement, one bar defendant will donate $25,000 to a foundation started in honor of Billy Kappel, implement annual safe-service alcohol training for its staff to help prevent similar tragedies in the future, and significantly lengthen its surveillance footage retention policy.

Under the terms of the parties’ settlement, other details, including the identities of the bar defendants and their attorneys, are unavailable.

Billy’s estate, Laura Kappel, and Jacqueline Zink were represented by Chuck Dukes of Rogers, Patrick Westbrook & Brickman, and Chris Moore and Terry Richardson of Richardson, Thomas, Haltiwanger, Moore & Lewis. Joseph Murray was represented by John Moylan and Lucy Dinkins of Wyche, P.A.

The settlement was finalized on Feb. 18th in front of U.S. District Court Judge David C. Norton.

Matt Nickles, who has worked as an associate at our firm since 2014, became a member at the beginning of this year.

A native of Columbia, Nickles was exposed to the law at an early age. His mother worked as general counsel for the state Department of Social Services and his father is a well-known attorney who took on the video poker industry.

It was those early experiences and the stories told around the dinner table that sparked an interest in the law. Nickles graduated with a degree in European history from Washington & Lee University and a law degree from the University of South Carolina School of Law.

During law school, he interned for the Honorable Margaret Seymour, a federal judge in the District of South Carolina, and clerked for RPWB.

Following graduation, he worked for a Columbia defense firm, Walker Reibold, before spending two years as a law clerk for the Honorable Richard Gergel.

The Chase Of PPP Fraud is On

When the federal government raced to release more than $2.2 trillion in coronavirus aid earlier this year, it did so knowing that some of that money would go to fraudulent claims.

With the money needed immediately by struggling businesses and workers, the government could not efficiently control fraud on the front end, so it was willing to pay invalid claims knowing it will chase the money through aggressive civil and criminal enforcement actions, a practice called “pay and chase.”

While the federal government chasing fraud is nothing new, never has the chase involved so much money, paid out to so many, in such a short period of time. And complicating matters is that PPP recipients by their nature, are small businesses, not the highly-regulated industries used to receiving federal aid.

Government officials believe a significant portion of the $2.2 Trillion was obtained through fraud and are acting accordingly. We are starting to see the first Paycheck Protection Program prosecutions, and the Department of Justice is gearing up for enforcement actions. Attorney General Barr has directed every United States Attorney’s Office to focus on detecting, investigating, and prosecuting all criminal activity related to the COVID-19 pandemic. Here in South Carolina, U.S. Attorney Peter McCoy has created a multi-agency task force to root out PPP fraud.

Although impossible to predict the exact contours of the coming enforcement actions, we are beginning to see patterns in the charging decisions:

  • There is a complex statutory and regulatory framework directly applicable to SBA Fraud. Knowingly submitting a false claim to the Small Business Administration, which administered PPP carries up to 2 years in prison and a $5,000 fine. Prosecutors also can charge for making a false statement to the government or to a financial institution, which carry up to 5 years and 30 years respectively.
  • The government can go after cases in which no money actually changed hands. Even conspiracy to defraud charges carry the risk of significant prison time. The primary driver for sentencing in these PPP fraud cases, absent extreme circumstances, will be the amount of money applied for in the fraudulent loans.
  • Criminal liability will be around for a long time. Due to the fact that PPP fraud will almost always involve a financial institution, federal prosecutors can charge crimes with 10-year statutes of limitation. This means PPP criminal liability will be out there until 2030.

People or businesses that find themselves a subject or target of a PPP or Cares Act fraud investigation should immediately retain a criminal defense attorney who focuses on white-collar crimes. Not only should the attorney be well-versed with the complex legal framework for PPP fraud cases, but it will also help if the attorney understands how the government intends to enforce it.

How are Mesothelioma Lawsuits Paid Out?

Some of the most frequent questions we get about mesothelioma lawsuits concern how they are ultimately paid out to clients and how long it will all take. To address those questions, let me give you a little bit of context about how mesothelioma lawsuits work.

When a person is diagnosed with mesothelioma, asbestos lawyers like myself work with that client and other witnesses such as family members and co-workers to determine all of the places he/she has come into contact with asbestos. In addition to identifying the exposure locations, we also work using a variety of sources to identify all of the asbestos products used at those locations. From there, we can start to build a product liability case against all of the manufacturers of those products. The best mesothelioma lawyers can walk you through this process to make it as easy as possible.

Most mesothelioma lawsuits involve a number of defendants that share culpability for causing the client’s mesothelioma. If the litigation is successful, the client will typically receive periodic settlement checks as various defendants settle. This includes both businesses in operation today and those that set aside money in bankruptcy trusts. This entire process can take several years from beginning to end, with most clients and their families beginning to receive money shortly after the case is commenced.

Of course, it is important to note that every case is different and a good asbestos attorney will not rush through building the product liability case against the asbestos manufacturers.  A well developed, researched, and prepared case will increase the likelihood of a successful outcome.  Additionally, if a case goes to trial, the time frame for case resolution may be extended

$1.5 Billion Syngenta Corn Farmer Settlement Finalized

Corn Farmer Settlement Checks Are On The Way

This week we received some very good news for corn farmers nationwide who suffered price losses associated with the botched launch of genetically-modified corn seed by Syngenta in 2013. On January 3, 2020, the U.S. District Court for the District of Kansas in Kansas City approved a $1.5 billion settlement to compensate thousands of farmers for their losses.

RPWB, along with our Beaumont, Texas- based co-counsel Mitchell Toups of Weller, Green, Toups & Terrell, LLP and Richard Coffman of the Coffman Law Firm, represented the owners of 2,600 farms growing roughly 500,000 acres of corn who saw the value of their corn plummet when China rejected imports of American corn due to it being co-mingled with corn grown from Syngenta Agrisure Viptera seed. The product has since been allowed by Chinese officials.

Corn farmers who are part of the settlement are receiving Notice of Determination forms that calculate the portion of the settlement they will receive when the checks are distributed later this year. We anticipate the checks will go out in late spring or early summer 2020. Unfortunately, there is still no way to calculate how much each farmer will receive until the Settlement Administrator verifies the total bushels of corn produced by all members of the settlement. We expect that information will be forthcoming in short order.

There is just one more step for eligible corn farmers. They must complete, sign, and submit an IRS W-9 form to the Claims Administrator to be paid. They may do so in one of two ways: (1) go to www.CornSeedSettlement.com and click SUBMIT MY W-9 FORM, or (2) complete the W-9 form included in the NOD, and mail it to: Corn Seed Settlement Program Claims Administrator, P.O. Box 26226, Richmond, Virginia 23260. There is no deadline to submit your IRS W-9 form, but until you do, you won’t be paid.
