      Who is eligible to file a quartz countertop lawsuit?

      Why are quartz countertops so dangerous?

      Quartz countertops are made by crushing quartz and mixing it with other minerals, dyes and polymers. The mixture is poured into molds where it hardens into slabs. When the slabs are cut and polished for installation in homes and businesses, a large amount of dust is produced. Most of this dust is actually silica because that’s what quartz is made of. In fact, 93 to 95 percent of the dust produced by quartz countertops is silica versus just the 3 to 5 percent found in the dust of marble countertops and the 10 to 45 percent found in granite .

      The particles of silica dust are so small that they can slip through respirators, masks and other worker safety devices. The best practice is to use a wet saw to cut quartz countertops, but that isn’t always a reality in the workplace. And even with the wet saw it is still possible for workers to be exposed to the silica dust.

      Silica particles are jagged and become lodged in the lining of the lungs. Your body is not able to extract the silica and a lung disease called pneumoconiosis can occur.

      What is pneumoconiosis and silicosis?

      Pneumoconiosis is a group of occupational lung diseases caused by inhaling dangerous types of dust particles.

      When the particles become lodged in the lining of the lungs, they cause inflammation. The body responds by building scar tissue around them. This scar tissue is thicker and more rigid than the lining of the lungs, making it more difficult for the lungs to expand and contract. The damage causes a lack of blood vessels and air sacs in the worker’s lungs. Over time, this makes it increasingly difficult for the worker to breathe.

      It typically takes several years for the lung disease to progress. In some cases it can result in death.

      Common examples include black lung in coal workers or asbestosis in workers exposed to asbestos.

      The form is pneumoconiosis caused by breathing in silica is also called silicosis. This is the form of lung disease that we are seeing in workers who install quartz countertops.

        The Source of the Water Contamination at Camp Lejeune

        Water testing at Camp Lejeune in the 1980s revealed the presence of several toxic substances in the water. The main pollutants in Camp Lejeune’s water from 1957 to 1987 were Tetrachloroethylene (PCE) and Trichloroethylene (TCE).

        For nearly thirty years, dangerous levels of PCE, which is commonly used by dry cleaners, were found to exist at the Tarawa Terrace water treatment plant that serves Camp Lejeune. The EPA’s maximum safe level for PCE in drinking water is 5 parts per billion. At Camp Lejeune, the water was found to have 215 parts per billion of PCE, which is more than 40 times the EPA’s maximum safe level for PCE in drinking water. Investigations found that nearby, off-base dry cleaners had been improperly disposing of the chemicals for many years. For just shy of 30 years, the Tarawa Terrace water treatment plant that serves Camp Lejeune was contaminated with dangerous levels of PCE.

        The other main contaminant found at Camp Lejuene, TCE, is used in the manufacturing of refrigerants and other hydrofluorcarbons and also commonly used as a degreaser on military equipment. The Hadnot Point water treatment facility servicing Camp Lejeune was highly contaminated with TCE. Testing found a peak of 1,400 parts per billion, which is well above the maximum 5 parts per billion that the EPA says is safe.

        Other contaminants found in the Camp Lejeune water system, include mercury and benzene. Supply wells were contaminated by multiple sources such as leaking underground storage tanks for petroleum products, industrial area spills, and waste disposal sites

        The pollution and water contamination was so bad that the EPA designated the area as a Superfund site in 1989 and cleanup efforts continue more than 30 years later.

          The Link between Paraquat and Parkinson’s Disease

          A growing body of science points to Paraquat as a cause of Parkinson’s disease.

          In his recent book, Dr. Bastiaan Bloem, a prominent neurologist who has published more than 700 scientific papers and chapters on Parkinson’s Disease, points to the tight link between exposure to herbicides such as paraquat — a weed killer — and the risk of developing Parkinson’s.

          “These chemicals were introduced worldwide after World War II, and many are still used today on our fields,” he said. “For this reason, farmers are at a markedly increased risk of developing Parkinson’s. If you feed a mouse paraquat — which is banned in China but not the U.S. — it will kill the dopamine-producing cells in the brain. These chemicals are tremendously toxic to the brain and have even been detected in milk, in supermarkets.”

          A recent study, published in the journal Toxicological Sciences in December 2020, confirmed that inhaling Paraquat gives it a direct pathway to the brain, where other studies have shown that it can impair dopamine receptors. Parkinson’s disease occurs when nerve cells in an area of the brain that controls movement become impaired or die. Normally, these neurons produce dopamine. When the neurons die or become impaired, they produce less dopamine, which causes the movement problems of Parkinson’s.

          Common symptoms associated with Parkinson’s disease include shaking or tremors, stiffness and difficulty with walking, balance and coordination. As the disease progresses, it can affect a person’s ability to talk and chew food. It can be associated with memory loss and other behavioral issues.

          In 2020, the EPA released new guidelines about the application of Paraquat seeking to reduce human exposure to the chemical, which is known to be toxic.

          Who is at risk?

          The use of Paraquat in the United States began in 1964, and continues to this day despite other governments such as China and the European Union already banning it. It is typically used in agricultural settings, but also is used on golf courses and in grounds maintenance at large facilities such as schools, parks, factories and other industrial sites. The people most impacted are those who mixed the chemicals or inhaled them during or just after application. This includes:
